User Agreement for Work Seekers

You (the “User”) hereby agree that the following User Agreement, inclusive of all schedules hereto (collectively, the “Agreement"), outlines the rules for using the services provided by The Agricultural Alliance of New Brunswick/L’Alliance Agricole du Nouveau-Brunswick Inc. (“AANB”), as a work seeker. Once you have agreed to them, you will need to continue following the terms every time you sign in. If there are any changes to these terms, you will be asked to reaccept the new version.

BY USING THE SERVICES, OR BY CLICKING TO ACCEPT THE TERMS, YOU ACCEPT AND AGREE TO BE BOUND AND COMPLY WITH THIS AGREEMENT AND OUR PRIVACY POLICY (AVAILABLE HERE), INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST NOT REGISTER FOR, ACCESS, OR OTHERWISE USE OUR SERVICES.

When used in the present Agreement, the term “Services” shall refer collectively to the services set forth in Schedule “A” to this Agreement, which are provided through a technology platform (the "Platform") operated by AANB to facilitate connections between Work Seekers and Work Offerors. AANB's role is that of a platform operator and facilitator; it does not act as a matching agent, employment agency, or intermediary except to the limited extent described herein..

User Acceptance of User Agreement

The Services are made available for use by individuals in the province of New Brunswick who are legally authorized to work in New Brunswick, Canada at the time of hire and who are searching for short term and/or temporary work opportunities (“Work Seekers”).

By accessing and using the Services:

  • The User confirms that the User has read and understood the terms and conditions of the Agreement, agrees to be bound by the terms of the Agreement, and has the legal authority and power to enter into the Agreement and provide any information required to use the Services in accordance with this Agreement. For clarity, the User confirms it has read and understood the terms and conditions of the Privacy Policy attached to this Agreement as Schedule “C” (the “Privacy Policy”).

The User represents and warrants that it is a Work Seeker.

The User acknowledges that AANB may share the information provided by the User in their Account with individuals or entities seeking Work Seekers, either on their own behalf or the behalf of another individual or entity (collectively, the “Work Offerors”). In the event a Work Offeror is interested in contacting the User, the User may be contacted by either AANB or the Work Offeror using the contact information provided by the User. The User further acknowledges that, as part of the Services, the Work Offerors may be granted direct access to certain information provided by Work Seekers through the Platform, which may include Work Seeker resumes, contact information, and profile information (collectively, "Work Seeker Data"). Such Work Seeker Data is made available solely for the purpose of evaluating Work Seekers for potential work opportunities and may not be used by Work Offerors for any other purpose. The nature and scope of Work Seeker Data accessible to the Work Offerors may change over time as the Services evolve, and AANB will update this Agreement accordingly.

On each occasion where a Work Seeker is considered by a Work Offeror for a work opportunity, the Work Seeker may be requested by the Work Offeror (or AANB on the Work Offeror’s behalf) to present themselves to a physical location related to the work being offered, in order for the Work Offeror to assess the User’s suitability for the work in question (a “Site Visit”). A Site Visit does not create an employment relationship between the Work Offeror and the Work Seeker and does not in any way guarantee that the User/Work Seeker shall be granted the work opportunity.

The User acknowledges and agrees that the User will not engage in any work for a Work Offeror for which they do not have the necessary skills, legal authority, or qualifications. The User acknowledges that AANB is solely relying on the authenticity and veracity of the disclosures of the User, without any obligation to perform further due diligence. The User bears any and all liability for any misrepresentation or omission in the information provided by the User.

The User acknowledges and agrees that AANB is not a party to, third party beneficiary of, or liable for, any agreements, offers or promises between Work Seekers and Work Offerors, except to the extent AANB has acted with gross negligence or willful misconduct in facilitating such introductions. AANB acts solely as a platform facilitator and assumes no responsibility for the performance, quality, safety, legality, or any other aspect of work arrangements between Work Seekers and Work Offerors.

The User acknowledges and agrees that AANB cannot and does not verify, confirm, or otherwise conduct any due diligence with respect to any information submitted by Work Seekers or Work Offerors through the Services, including without limitation their identity, their capacity to pay, their capacity/eligibility to work or offer work (as applicable), or any other data that is provided in connection with the Services. AANB makes no representations or warranties, express or implied, as to the accuracy, completeness, or truthfulness of any information received from or about Work Seekers or Work Offerors, and AANB relies solely and entirely on the information provided as though it were true and accurate, without any obligation to investigate or validate such information. AANB does not inquire into the backgrounds of Work Seekers or Work Offerors, and does not verify any diplomas, certifications or accreditations.

The User acknowledges and agrees that the User is solely responsible for performing any and all due diligence required in order to satisfy themselves as to the relevant information of a given Work Offeror prior to entering into any work arrangement.

The User acknowledges and agrees that it is solely liable for any damages related to (i) the content of its Work Seeker Account; (ii) the decision to proceed or not proceed with any initial or subsequent contact, Site Visit, meeting, interview or offer of work; (iii) any issues that may arise from an acceptance or denial of a work opportunity; or (iv) any other issues that may arise from use of the Services, except to the extent such damages are directly caused by AANB's gross negligence or willful misconduct.

Approved Use of Services

By using the Services for any purpose other than as described in Schedule “A”, including but not limited to the restricted uses described in Schedule “B” (collectively, the “Restricted Uses”), the User agrees to immediate termination of User’s access to the Services and this Agreement, the whole without prejudice to AANB’s other rights and recourses against the User under the Agreement or at law.

User acknowledges that AANB has the right to notify regulatory authorities, financial institutions and or third party service providers, as appropriate, when Restricted Uses require such actions, at the sole discretion of AANB.

Work Matching Services

As part of the Services, the Platform may present work recommendations in various formats to the User as a Work Seeker (the “Matching Services”). For example, AANB may recommend work offers from Work Offerors which correspond to the User’s Account based on their disclosed location and skills. AANB may also present the User’s Account to various Work Offerors if the work being offered corresponds with some or all of the information in the User’s Account. The Matching Services are one component of the Platform and are intended solely to facilitate potential connections between Work Offerors and Work Seekers; they do not constitute a guarantee, endorsement, or active vetting of any Work Offeror or work opportunity. As the Services develop, Work Offerors may be granted direct access through the Platform to Work Seeker Data (as defined in Section 1(b)(iii)) without AANB acting as an intermediary.

To generate matches for the Matching Services, AANB reviews the data provided by the User, including data provided by Work Seekers and Work Offerors. The User agrees and consents that AANB may use the information provided by the User and/or Work Offerors to generate and present potential matches to the User and/or to Work Offerors.

The User acknowledges and agrees that AANB does not act as an employment agency, is not procuring employees for employers or procuring opportunities for Work Seekers, and has no obligations or duties typically associated with employment agencies under New Brunswick or federal law. AANB’s Platform is provided on an "as-is" basis to facilitate contact between Work Offerors and Work Seekers. The User further acknowledges that AANB provides the Services to Work Seekers at no charge, and accordingly, the User has no contractual right to demand any particular level of service, matching quality, response time, or platform availability. The Matching Services do not constitute an employment agreement or any other agreement between AANB and the User.

The User acknowledges and agrees that the Services act solely as a matching platform and does not coordinate, guarantee, or manage transportation or commuting arrangements. Any transportation requirements or arrangements are solely between Work Offerors and Work Seekers.

Use Rights and Restrictions

AANB reserves the right to approve or decline the use of the Services by any person at its sole discretion. To open an Account (as defined in Schedule “A”) and use the Services, the User agrees to ensure use of the Services complies with this Agreement. User agrees to:

  • Provide any information required in order to open an Account. The required information may include, but not be limited to: name, email, address, phone number, confirmation of legal authorization to work in Canada at the time of hire, access to transportation, valid link to résumé, as well as acceptance to all terms and conditions required during the opening of the User account.

Safeguard the credentials to access the Account, update the credentials as recommended by the Services, and never share the credentials with any person and/or organization that is not registered as User in the Account.

Take full responsibility and hold AANB harmless from any loss or damages deriving from unauthorized access to the Account with the User credentials, except where such unauthorized access results from AANB's failure to implement reasonable security measures.

Authorize AANB to store and access the information provided to open the Account, solely for the purpose of providing the Services, including sharing the information with third party service providers, and Work Offerors in accordance with this Agreement and the AANB Privacy Policy, attached as Schedule “C”.

Authorize AANB to share data and information related to the Users use of the Services in an aggregate and anonymized manner, including to compile statistical and performance information related to the provision and operation of the Services.

Amendments

The Agreement may be modified at the sole discretion of AANB, at any time, by notifying the User of any changes electronically via the Services interface and/or via email. For any material amendments to this Agreement - including but not limited to amendments that affect: (i) the nature or scope of Work Seeker Data accessible to Work Offerors through the Platform; (ii) the User's obligations with respect to personal data or privacy; (iii) AANB's limitation of liability provisions; or (iv) the dispute resolution mechanism - AANB will require the User to affirmatively accept the updated Agreement by clicking "I Accept" or an equivalent acknowledgment mechanism before the User may continue to access the Services. For non-material amendments, you agree to periodically review the terms of the Agreement in order to be aware of any such modifications and your continued access to, and use of, the Services after the effective date of such changes represents User agreement to the modified Agreement. If the User does not agree to any modifications, whether material or non-material, the User may terminate this Agreement in accordance with Section 8(a). AANB will use reasonable efforts to distinguish material from non-material amendments in any notification provided to Users.

Limitation of Liability and Warranty Disclaimer

In no event shall AANB (or its affiliates, directors, officers, employees, consultants, shareholders, advisors and third party data service providers) have any liability for any consequential, indirect, incidental, special or punitive damages, arising out of or relating to the Services or the arrangements contemplated herein, including but not limited to lost profits, lost business opportunities, lost data, or costs of procurement of substitute services, except to the extent such limitation is prohibited by law. No warranties other than what are set out in this Agreement shall apply.

By using our Services, you agree to do so entirely at your own risk. You also agree that AANB Services are provided under this Agreement on an "as is" and “as available” basis, without warranty or representation of any kind, either expressed or implied, including but not limited to warranties that the Services is free of software defects, merchantable, suitable for any particular purpose and/or non-infringing. This disclaimer of warranty constitutes an essential part of this Agreement. No use of the Services is authorized hereunder except under this disclaimer.

Services may become inaccessible, be interrupted and/or not in operation for multiple reasons beyond the control of AANB. AANB will make reasonable efforts to ensure that Services are restored in a timely manner.

Notwithstanding anything else in this Agreement, AANB's total aggregate liability to User for any reason shall not exceed $100.00 CAD.

Indemnification

User shall defend, indemnify and hold harmless AANB (and its affiliates, officers, directors and employees) from and against any and all damages, costs, losses, liabilities or expenses (including court costs and reasonable attorneys’ legal fees) which AANB may suffer or incur in connection with any actual or threatened claim, demand, action or other proceeding by any third party arising from or relating to: (a) any breach of any provision of this Agreement by User, (b) any actions taken by AANB pursuant to the User instructions while using the Services, (c) any unauthorized access and or breach to User’s data that affects the Services, (d) User's violation of any applicable law or regulation in connection with use of the Services, and/or (e) any third-party indemnity obligations AANB may incur as a result of the User’s acts or omissions, in connection with the Services.

Termination of Services

The User may request at any time the closure of the Account and termination of the Agreement by choosing the option “close account” within the Services dedicated Account management area. Any request to close the Account and terminate the Services will be reviewed by AANB for outstanding User obligations prior to final closure of the Account.

AANB may terminate this Agreement and close the Account for any reason and at any time. Closure of the Account may be the result of inactivity, unacceptable use of the Services as described in Schedule “B”, or any other reason in AANB’s sole discretion. AANB will make reasonable efforts to notify the User in advance of termination of Services and the closure of the Account, but has no obligation to do so.

Following the closure of the Account, the User remains liable for any and all commitments and obligations arising from the use of the Services, including but not limited to the provision of any information required for the compliance of regulatory requirements related to the Account.

Electronic Communications

The User acknowledges that electronic communications may include electronic signatures, important notifications, disclosures, alerts, any service messages, transaction information, reports, transaction approvals and/or cancellations, termination of the Agreement, as well as updates, modifications and amendments to the Agreement, including but not limited to the terms and conditions, rules and regulations affecting the Account and/or the Services, and claims related to the use of the Services (collectively “Electronic Communications”)

The User acknowledges that it may receive Electronic Communications from AANB, via the User’s Account, the Services or email. All communication from AANB to User will be Electronic Communications and will be deemed as delivered in writing at the time of transmission.

The User acknowledges that it has the ability to access the Services and has an email address to receive Electronic Communications. The email address must match the one registered in the Account for the provision of the Services.

All Electronic Communications to AANB should be performed using the Services’ dedicated area for contact and/or Support, and/or emailed to AANB Electronic Communications that are related to activities within the Services, including transactions, fees, registration information, and more, shall be sent from the email address registered in the Account or may not be answered to prevent any breach of privacy.

Intellectual Property

AANB retains all rights, title and interest in the Services, and all software, specifications, methods and/or processes that provide the Services, as well as any logos, marks, trademarks, Internet domains, graphic design, icons, content and/or interfaces that are part of the Services. The User shall not copy, use or distribute any of them without AANB’s written consent. All rights in and to the Services, the software used to provide the Services, and any and all content developed, created or derived from the Services is the exclusive property of AANB.

If the User provides AANB with any feedback regarding the Services, AANB may use all such feedback without restriction and shall not be subject to any non-disclosure or non-use obligations in respect of such feedback. Nothing in this Agreement shall be interpreted to provide User any rights in the Services except the limited right to use the Services subject to the terms and conditions of this Agreement.

Dispute Resolution

Any claim and/or dispute between the User and AANB, arising from use of the Services and/or as a result of this Agreement, shall first be subject to good faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be resolved by binding arbitration. Binding arbitration will be provided by the ADR Institute of Canada (“ADR”) under the ADR's Arbitration Rules, or such other arbitration rules as the parties may mutually agree.

In case of binding arbitration, the prevailing party shall be entitled to recover any fees and reasonable costs incurred in connection with the arbitration. Any decision made by binding arbitration will be final and binding for the User and AANB.

The User agrees and acknowledges that by accessing the Services, subject to applicable law, it is giving up its right to have any claims against AANB resolved by a court and/or trial by jury, and/or to participate as a claimant in any class action lawsuit against AANB, except where such waiver is prohibited by law.

Miscellaneous

This Agreement together with its Schedules, represents the entire agreement between AANB and the User regarding the subject matter hereof and supersedes any and all other agreements between the parties, whether written or oral, regarding the subject matter hereof.

A waiver of any default hereunder or of any of the terms and conditions of this Agreement shall not be deemed to be a continuing waiver or a waiver of any other default or of any other term or condition, but shall apply solely to the instance to which such waiver is directed. Failure by AANB to exercise any right or take any action against any breaches of this Agreement does not constitute a waiver of its rights to do so at a later date.

User may not assign any rights under this Agreement; any attempted assignment shall be null and void. AANB may freely assign, transfer, or delegate any or all of its rights and obligations under this Agreement without notice to or consent from User.

If any part of this Agreement is found to be invalid or unenforceable, such part shall be interpreted to give the maximum force possible to such terms as possible under applicable law, and such invalidity or unenforceability shall not affect the validity or enforceability of any other part or provision of this Agreement which shall remain in full force and effect.

By accessing or using the Services, you agree that all matters relating to your access to, or use of the Services under this Agreement shall be governed by the laws of the province of New Brunswick, exclusive of conflicts of laws principles, and applicable federal laws of Canada therein. You also agree and hereby submit and conform to the jurisdiction of the courts of New Brunswick with respect to such matters.

Schedule “A”

Description of Services

AANB operates the Platform, a technology facilitation platform designed to connect Work Seekers and Work Offerors. As part of the Platform, AANB provides Matching Services (as defined in Section 3(a.) of the Agreement), which are a subset of the Services available through the Platform. As the Platform develops, additional functionality may be made available to Work Offerors, including direct access to Work Seeker Data, as further described in this Agreement.

Users are provided with a user account (“Account”) that accesses the Services using a set of credentials managed by AANB.

For the Matching Services, AANB uses data collected with the User Account. This includes information provided to AANB to open an Account. Users agree and consent that AANB may use this information to present potential matches to you and to potential Work Offerors.

AANB may facilitate initial contact between Work Seekers and Work Offerors based on work matches. As the Services develop, Work Offerors may be granted the ability to directly access Work Seeker Data through the Platform and to initiate contact with Work Seekers directly, without AANB acting as an intermediary.

AANB may reach out to Work Seekers to assess interest and availability to complete work for Work Offerors and inform them of the Work Offerors of rate of pay.

The Services may transmit electronically any data relating to the processes described above to the User’s system, and/or enable the User to export said data in different formats available in the Services.

Schedule “B”

Restricted use of Services

User is not permitted to use the Services in any of the following ways or for any of the listed Restricted Uses:

  • Harm anyone or violate the rights of anyone, including the right of publicity, right of privacy, or intellectual property rights.

Provide false information.

Transmit or store biometric information or biometric identifiers.

Promote or encourage illegal activity.

Send unsolicited commercial messages, or any other unlawful communications.

Imitate or impersonate another person, or create false accounts.

Sell personal data.

Provide any code or data with the intent or effect of damaging, disrupting, disabling, harming, impairing, interfering with, intercepting, expropriating or otherwise impeding, the Services or any data, program, system, equipment or communication, or that would cause a violation of any applicable law.

Access any data, especially personal data, without permission.

Bypass any limitations or suspensions of functionality.

Interfere with others’ use of the Services.

Modify, adapt, translate, reformat, resell, frame, or reverse engineer any portion of the Services.

Remove any copyright, trademark or other proprietary rights notices.

Schedule “C”

Privacy Policy

We are The Agricultural Alliance of New Brunswick/L’Alliance Agricole du Nouveau-Brunswick Inc.. (“AANB”, “we”, “our”, or “us”), and we are committed to transparency with respect to our practices in handling personal information. To that end, this Privacy Policy describes how we collect, use and disclose personal information of our users (“Users”, “you”, or “your”) that use our Matching Services (the “Services”), and the information we collect, use and disclose on behalf of our Users – for example, related information collected from Users to create an account (“Account”). As the Services are available to Users in New Brunswick, this Privacy Policy is intended to satisfy the requirements of rules established by applicable law, including the Canadian Personal Information Protection and Electronic Documents Act (“PIPEDA”), and the Canadian Anti-Spam Legislation (“CASL”).

When used in this Privacy Policy “personal information” means any information that we can reasonably use to directly or indirectly identify individuals such as an individual’s name, mailing address, email address, telephone number, internet protocol (IP) address, user name, or other similar identifiers. Personal information that is aggregated or anonymized and cannot be associated with an identifiable individual is not considered to be personal information under this Privacy Policy.

Application and Scope

This Privacy Policy applies to the personal information we collect, use and disclose through the AANB Services.

This Privacy Policy governs personal information collected through use of the Services. It also explains how we use cookies and similar technologies.

By using the Services, or interacting with us in any manner, you acknowledge that you have read and understood this Privacy Policy and you explicitly agree to its terms and the collection, use, and disclosure of your personal information as described herein.

Collection of Personal Information

We collect and use personal information shared directly with us by Users. We also automatically collect technical information through our website and platform found at https://fermenbfarm.ca, using cookies and other digital markers. You may adjust your browser settings to reject digital markers, including cookies, if you so choose, but in such a case we may not be able to provide you with all our website/Platform functionalities. By continuing to use our Services after being informed of our use of cookies, you consent to such use.

AANB collects the following personal information:

  • Personal Information. We collect certain personal information about the User (name, email, address, phone number, login password, user name, link to User résumé). This information is provided and input manually by the User.

Technical information. When you use our Services, we may collect, using electronic means such as cookies, technical information. This information may include information about your visit to our website and platform including the IP address of your computer or device and which browser you used to view our website and platform, the time you accessed or used our website and platform, your operating system, resolution of screen, location, language settings in browsers, the site you came from, keywords searched (if arriving from a search engine), the number of page views, information you entered, advertisements you have seen, etc. This data is used to measure and improve the effectiveness of our website and platform or enhance the experience for our Users. We treat this information as personal information when it is associated with your account or contact information.

Your Choice with Cookies. You can block the use of cookies by activating the settings in your browser. The “Help” feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. If you choose to withhold consent, or subsequently block cookies, you may not be able to access all or part of the content of our website. Additionally, you can disable or delete similar data used by browser add-ons, by changing the add-on’s settings or visiting the website of its manufacturer.

Privacy Policies of Third Parties. This Privacy Policy only addresses the use and disclosure of information by AANB. Other websites that may be accessible through our website or platform may have their own privacy policies and data collection, use and disclosure practices. We encourage you to familiarize yourself with the privacy statements provided by all third parties prior to providing them with information or taking advantage of an offer or promotion.

Use of Personal Information

We use personal information to provide products and Services to our Users, and for our internal purposes.

We collect personal information for the following purposes:

  • to establish, develop and preserve our business relationship respectively with our Users, and other persons with whom we deal;

to create, establish and administer Users’ accounts and to respond to Work Seeker or Work Offeror inquiries;

to provide, operate, and maintain our Services;

to meet applicable legal, regulatory, and contractual requirements relating to the Services provided to Users;

to ensure our records are accurate and to protect Users and AANB from error and fraud;

to understand and assess the interests, wants and changing needs of Users with a view to improving our services and developing new ones; and

to provide personalized services as well as work matches and recommendations to Users.

We also use your personal information (subject to an individual’s right to withdraw consent):

  • to personalize our advertisements to ensure that such advertisements are of relevance for our Users;

to conduct surveys on the quality of our services or User service.

When possible, rather than using personal information, we will anonymize and/or aggregate personal information so that it no longer identifies an individual, and use it for the purposes mentioned above or any legal purpose.

Unless required or authorized by law, AANB will not collect or use personal information for any other or new purpose without obtaining further consent.

Consent

BY CLICKING “I ACCEPT”, ACCESSING OR USING OUR PLATFORM AND SERVICES IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND EXPRESSLY AGREE TO BE BOUND BY THIS PRIVACY POLICY AND CONSENT TO THE COLLECTION, USE, PROCESSING, AND DISCLOSURE OF YOUR PERSONAL INFORMATION AS DESCRIBED HEREIN. YOUR CONTINUED USE OF THE SERVICES CONSTITUTES ONGOING ACCEPTANCE OF THIS PRIVACY POLICY AS IT MAY BE AMENDED FROM TIME TO TIME.

AANB obtains consent of individuals for the collection, use, processing or disclosure of personal information at or before the time of collection. The form of consent sought by AANB will vary according to the sensitivity of the personal information, the reasonable expectations of the individuals and any requirements or standards established by law.

By creating an AANB Account and/or submitting information to us in connection with using AANB Services you are providing your consent to the collection, use, processing and disclosure of personal information as set out in this Privacy Policy, and, as applicable, in any agreement you may enter into with us. Moreover, by interacting with and/or using our platform and Services, you agree to benefit from, and be bound by, the terms and conditions of this Privacy Policy.

Right to Withdraw Consent

5.1 Any individual can withdraw their consent to our use of their personal information at any time. For example, at any time, an individual can opt-out from receiving any of our emails. However, withdrawal of consent to use or disclose personal information may mean that we are not able to provide you with all of our services. We may nonetheless retain your information if we have a legal basis to do so.

5.2 If you withdraw your consent to the use, processing or sharing of your personal information for the purposes set out in this Privacy Policy, we may not be able to provide you with all (or any) of our Services. In certain cases, we may continue to use the personal information after you have withdrawn consent if we have a legal basis to do so, or if your withdrawal of consent was limited to certain processing activities or to certain elements. For example, we may keep information if we need to do so to comply with a legal obligation, to resolve disputes and to enforce our agreements.

5.3 Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice; however, without such consent, AANB may limit the services it is able to provide Users. To withdraw your consent, contact us at rcagrinb@fermenbfarm.ca.

Sharing of Personal Information

We may disclose aggregated information about our Users, and information that does not identify any individual, without restriction. We may share personal information that we collect or you provide as described in this Privacy Policy with third parties, solely as necessary to provide our Services. Third parties are contractually prohibited from using personal information for any other purpose than servicing AANB. AANB will strive to protect personal information disclosed to third parties by contractual agreements requiring that those third parties adhere to commercially reasonable confidentiality and security procedures and protections that are, at a minimum, equivalent to those employed by AANB itself.

Personal information may be made available by AANB to third parties only to fulfill the purposes for which it has been collected, as set forth in this Privacy Policy, with your consent, or as permitted or required by law. AANB will NOT share, sell, rent or trade your personal information to any third party for their marketing purposes. However, we may share personal information as follows:

  • To Work Offerors to fulfill the Services. As part of the Matching Services, Work Seeker Data may be made available directly to Work Offerors through the Platform for the sole purpose of evaluating Work Seekers for potential work opportunities.

To third party service providers and partners. We may hire service providers, which may be affiliates or third parties, to perform services on our behalf. This may include, without limitation, a person or an organization retained by AANB to perform work on its behalf, payment processors, where applicable, for any billing and payment processing, or cloud infrastructure and hosting providers used to operate and deliver the Services.

Third Party Integration. Our Services may involve integrations with, or may direct you to, websites, apps, and services managed by third parties. By interacting with these third parties, you are providing information directly to the third party and not AANB and subject to the third party’s privacy policy. If you access third-party services, such as social media sites or other sites linked through the Services, these third-party services will be able to collect personal information about you, including information about your activity on the Services. If we link to a site or service via our Services, you should read their data usage policies or other documentation. Our linking to another site or service doesn’t mean we endorse it or speak for that third party.

As permitted or required by law. From time to time, AANB may be compelled to disclose personal information in response to a law, regulation, court order, subpoena, valid demand, search warrant, government investigation or other legally valid request or inquiry. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful or to law enforcement and emergency services providers, in an emergency or where required or permitted by law. We may release certain personal information when we have reasonable grounds to believe that such release is reasonably necessary to protect the rights, property and safety of others and ourselves, in accordance with or as authorized by law.

As requested by Users. We may also share information with third parties at the request and direction of our Users, including as a part of our Services. We provide such third parties with only that information which is necessary in order for them to provide the services required, or that we have been instructed to provide by our Users. All such third parties are prohibited from using the information for purposes other than to facilitate and carry out the services they have been engaged to provide. These service providers are not permitted to disclose this information to others.

Storage of Personal Information

7.1 AANB processes and stores data in the cloud within Canada only. AANB does not transfer, store, process, or otherwise cause personal information to be transferred to or accessed from any foreign jurisdiction for the purpose of providing the Services. All personal information collected, used, or disclosed in connection with the Services is maintained on cloud infrastructure located within Canada and remains subject to the laws of Canada and the applicable laws of the province in which such information is stored.

Security of Personal Information

8.1 We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, unauthorized access, use, disclosure, copying, modification, or destruction.

We use reasonable security measures appropriate to the sensitivity of the personal information to protect it against unauthorized access, use, loss, disclosure, copying, modification, and destruction. AANB has implemented security measures that contain administrative, technical and physical controls that are designed to safeguard your personal information. Information stored in the Cloud is subject to contractual protections between AANB and the service provider that require the service provider to implement security measures at least equivalent to those required under this Privacy Policy. When we transmit sensitive data (such as messages, attachments, etc.) over the Internet, we protect it through the use of encryption. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Retention

9.1 We only retain personal information for the time period reasonably necessary to fulfill the purpose for which it was collected and in accordance with applicable law. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

AANB retains personal information for as long as is necessary to provide the services requested by Users, or for other essential purposes such as complying with our legal obligations, maintaining business records, resolving disputes, enforcing our agreements, and protecting our legitimate business interests. Personal information will be retained only as long as necessary for the fulfilment of the purposes for which it was collected and for which consent was received, unless otherwise required by law. Personal information that is no longer required to fulfil the identified purpose will be securely destroyed, deleted, or anonymized. Where deletion is carried out through backup rotation, complete deletion may take up to thirty (30) days, as individual records cannot be selectively retrieved from backup systems; only full backup sets are accessible.

AANB maintains nightly backups for a rolling thirty (30)-day period, and monthly backups for a period of three (3) months thereafter. Because backups are stored at the aggregate level and individual records cannot be selectively extracted or deleted from backup sets, the complete deletion of a User's personal information from all backup media may take up to thirty (30) days following a deletion request. Upon request, AANB can immediately purge all backups older than ten (10) days, in which case complete deletion may be confirmed within that timeframe. AANB may notify the User upon confirmation that deletion is complete.

Access and Correction

10.1 It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. Individuals have the right to access their personal information held by AANB and to have it corrected.

AANB respects individuals’ right to access and correct their personal information, subject to exceptions permitted by applicable law. If you have an account with us, you can log in at any time to access and update the personal information you have provided to us. If you need assistance with the access or correction of personal information, please contact us using the contact information detailed below. We will respond to access requests within the timeframes required by law, and in any event within 30 days of receipt unless an extension is required and permitted by law. Note that we will request additional personal information from you to verify your identity before any corrections are made or access is provided. This additional information will only be used to verify your identity and will not be used for any other purpose. We may charge a reasonable fee for processing access requests where permitted by law, particularly for requests that are repetitive, excessive, or require significant resources to fulfill. AANB will only charge such fees where User has been informed of the approximate cost and the individual has advised that the request is not being withdrawn.
